Epic orc

Not sure if I cannot figure out how to use the search correctly or nobody has asked this question before but when you are playing with epic rules and an orc draws a level 1 and chooses to eat it he only gets 1 leven even if he is 10 over correct or does he get 2 levels when he chooses to e4at it instead of fighting it?
