G.U.A.L and Charity

Situation: 3 players at level 9. Player 1 has to give cards out as charity. One of the cards is a G.U.A.L. card. Since there is no lowest level to give charity to, can you play that card as if you were going up a level, and since you can't, it just acts like a discard? Is that legal?

The rules for Charity say that if you're lowest, or tied for lowest (which is exactly the situation you describe), then you must discard your excess cards. So, there's no reason to try to play, legally or illegally, cards on yourself that would have no effect, in this instance, just so you can discard them.
