I've always taken height into account. We allow "stacking" of areas vertically in those instances where you want to affect more than 4 yards up. I've always felt like it offers fun creative possibilities.

<shrug> a Bird 5 yards above the ground of anon-stacked Area spell is not in the Area but a giant with his feet in the Area is affected even if his head is above the Area.

There would be a common sense exception for Area Spells whose function is to obscure vision though the giant wouldn't be able to see his own feet that were in the Area.
