End Game Question: Thief + Halitosis

A Level 9 Thief rolls a die and successfully steals another player's Potion of Halitosis. The Thief then causes trouble with Shadow Nose, using the stolen Potion on it for the win.

The Thief begins celebrating his win, but then another munchkin plays Feline Intervention to invalidate the Thief's die roll, attempting to thwart the theft of the Potion of Halitosis.

The Thief is arguing that the Potion was "instant" and therefore left no time for the other munchkin to play Feline Intervention. Munchkin 2 disagrees, believing that Feline Intervention applies "at any time".

Which player is correct?
