2 questions on the mind gem (discard 3 cards to force a player to help for first pick of treasure)

1. Can i force a player to help when im winning already?

2. Can i at lvl 8 force a player to help which at this point would be me going for level 9. Then once theyre in use a gual card on myself and theyre still stuck helping me?
