the dying curse VS baby oil

The curse says suffer bad stuff from the top monster in the discard pile. My brother is throwing cards mad that I am telling him he's not allowed to use "baby oil" as he is not in combat

baby oil says something like use this card during combat to slip away (automatically escape from) any monster.

I ask him "if you're in combat, why dont you kill it?"

Dying Curse does not cause combat and you can't Run Away from it.
