What does that have to do with defending? If someone attacking is harder to hit, that's a penalty to hit. Not withstanding the fact that someone doing AOA might not move, or even be moving to attack - AOA (Determined) with a ranged weapon is clearly meant to represent a shooter making no attempt at all to move or react to attacks except by maximizing his hit chances.

I'm sorry, I just see a real, actual need for "does not defend at all" as a level of attack, and no amount of penalties will replace that need.
