psycho squirrel + help me out + spiked codpiece

A level 1 male character with no items faces a psycho squirrel. He has a help me out card, and another player has a spiked codpiece. Can he use the help me out to steal the codpiece, or does the squirrel flee, and therefor he cant steal the codpiece in the first place?

The Spiked Codpiece means the difference between winning and losing the battle at that point in time, so it would be acceptable. Immediately after taking the Spiked Codpiece, the Psycho Squirrel is immediately discarded as it does not fight. The player is then winning an empty combat worth no levels and no Treasure, but he gets to keep the Codpiece.
