I know. But there's a world of difference between that and demanding that everyone, even noncombatants, kill a certain class of people on sight and without even a cursory trial. And yes, ship captains had the power to pass judgement on their crew and on any pirates who happened to fall into their hands. But ship captains actually had the authority of magistrates at sea because they were cut off from higher authorities.
