Since it's a secondary effect that affects the entire party, I would actually allow it to be played, and then only those players not at Level 9 could go up a level.

2. Itching Poweder - is headgear a piece of clothing? A player tried to use it on a tin foil hat but it was argued the hat was not armor (specified armor on the card) and it was a hat so it wasn't clothing. I'm sure there is a ruling somewhere in these threads but it's late.

If it's something you'd wear on your body (which includes Headgear, Armor, and Footgear), it's clothing.

It does not have a Gold Piece value (which includes the phrase "No Value"), so it is not an Item.
