You should be able to largely maintain your posture and still do a leg grapple. Essentially, you kick both legs up and wrap them around the target, then you can either stay like that (in a posture admittedly closer to sitting than standing, but in midair) or let your legs come back down, essentially straddling the target (but, again, in midair). The effects of these postures don't really apply in midair, because you aren't reliant on your legs to give you full elevation or indeed to stay upright - your ability to fly has you covered there.

Difference in time to do a posture change when flying are, I believe, outside the scope of this thread; best not to derail it.

I would consider that an oversight; I see no reason why a character who is unreliant on legs to stay in their current posture (either due to being in a posture where the legs aren't supporting the character's weight, or because the character is flying) would be unable to use all of them for leg Parries.
