Rules Question: Joe Legbreaker

Joe Legbreaker's text states that he can be squished (IF the thief has been caught cheating) to deal three damage to an opponent if he is in the stash. Does it matter whether he is face-up or not?

Face-down cards in the stash have no characteristics or abilities.
