cheat with magic items
can i use cheated magic items when i fight rational monster, or in any other situation, that prevents me from using magic items?

I'd think not.
Cheat only realy applies to items that you can't use due to class/race and number of slots available restrictions. I don't think applies to outside restrictions from monsters. |

The Cheat card or MQ is far more expansive in its scope, but even in this case, I'm inclined to say that it's still a Magic Item, and that Cheat doesn't remove (nor does it fully imply that it removes) a keyword from an Item. I'd like Andrew to confirm, however, since I know that we've found this version of Cheat to confuse even us.

We have ruled in the past that Cheat! does not remove an item's inherent nature -- for instance, Cheat!ed armor is still armor, and therefore vulnerable to a Lose Your Armor curse or trap. So I would agree with MunchkinMan; it's still a magic item and you can't use it if the monster or room prohibits the use of magic items.
Here might be a better way to look at it: Cheat! removes any prohibitions on use that stem from the wielder, but does not apply to any external conditions.
