Default Whine at the GM - Who is highest lvl?

Hello, my friends!
Whe have a conflict situation. Maybe you could help to figure out the true.
So this is the point.

(sorry for my English)
All players have a 2 lvl. One of the players says that he is playing the "Whine at the GM" card. Card text :"You can't use it if you are currently the highest-Level player, or tied for highest".
The quesstion is can he play this card?
Case 1. No, he is not. Cause at now all of the munchkins have the same lvl and it is highest lvl = he is the tied for highest.
Case 2. Yes, he can. Cause "the highest-Level" means that someone have a lower lvl. So if we have no players with lower lvl, so he can't be the highest-Level. And if he is not highest-Level so he can play this card.
Could you help to figure how is right plz?

If no one is higher than you, you are the highest Level and cannot use the card.
