Before I would have pegged it as a disadvantage (even if you were at a higher combat level, since it removes choice), but I can see how it could just be the circumstances of the encounter, along the lines of Lawyer vs. Super-Thief.

I have seen similar rulings that have termed exclusions like this a disadvantage. It's an optional thing which only Halflings cannot do. It differs from the Thief vs. Lawyers as that is an effect that automatically happens with no choice involved and it is ambiguous as to whether it helps you or hurts you.
Note also that MunchkinMan clearly stated the deal for Treasure is an advantage of being a Thief, something optional that only a Thief can do. Thus, something optional that only a Halfling can't do is a disadvantage. |
