Avoiding Thief abilities

So someone in my game was trying to avoid someone using the Theft ability the person discarded the item the person was trying to steal is this legal?

No. You can't simply discard Items just because you want to do so. A Reloaded Die (not a Loaded Die) can stop a die-based theft ability. Otherwise, once the player has established that they are going to attempt a theft and paid the cost (e.g., discarding a card as per Thief), you have to let them go ahead and try.
