I think, as regards to the existing pdfs where there are issues of layout, art, etc, as stefanj notes, it means that both parties have rights to different aspects of the pdfs, and neither can publish them without permission of the other. Situations like this with derivative works are not impossible under copyright law, and frequently come up with, eg, translations, where the original author owns the rights to the underlying work and the translator owns the rights to specific translation.

However, Jeff Dee & Jack Herman could publish a new set of pdfs, doing their own art and layout, since they still own the copyright on the underlying game and the Villains & Vigilantes trademark.
