Aspey of the U.S. District Court for Arizona ruled on January 15 that Jeff Dee and Jack Herman own the rights to the game based on the 1979 contract they reached with publisher Scott Bizar of Fantasy Games Unlimited. The court also found that Bizar never had the right to sell derivative products or ebook PDF editions of the game, two things he has been actively doing in recent years.

Jeff Dee & Jack Herman are playing it safe and waiting for FGU's appeal to get processed before making any formal announcements. (They had to post a formal apology for some of the things they said about their claims earlier in the proceedings.)

Posts in the V&V forum suggest that they are continuing development of a new game, though.

I started two adventures for V&V before the full extent of the legal mess was known to me. I'll finish them once things get settled.

But I expect things will be up in the air for a while yet!

Pity. :-(

However, assuming Jeff and Jack win the appeal, does that mean that MHG owns the PDF versions of all of the classic V&V modules? (Given that Mr. Bizar doesn't have the right to publish the old modules as PDFs.)

I really don't know.

FGU was old fashioned in that the authors had the copyrights. But the artwork and layout and such is another story. It could be that MHG could say "you can't publish that!," but they couldn't publish the V&V PDFs themselves w/o getting new art and such.

If MHG and FGU could work out an agreement, I wouldn't have a problem with FGU continuing to sell my old stuff. I've been getting a trickle of royalties from it. But I'd like to rewrite some of the books. Could MHG publish a new version while FGU continues to distribute the old?

I'll stay tuned, like everyone else.
