Default Charity round phase

I have a card that says to discard my hand and start a new turn after charity phase. The card is called "but there's still no cake" from a penny arcade booster pack.

I feel that this card is specifying after charity phase just to let the munchkins know that have to reduce their hand count to 5 before trying to discard the whole thing. I only had 4 cards in my hand and tried to play this card. It caused people to quit in an argument where I was saying charity doesn't have to happen, the phase just has to pass.

I guess the question is does charity phase happen or pass even if the person doesn't have cards to put them over their limit

You were correct. The Charity phase of your turn happens whether or not you have to give Charity.
