Because the USA isn't Japan. The two countries have different laws, different values, and different ideas of what justice is - on the whole, they're similar, but they are not a 100% match.

A lot of the confusion with the Macross (and other anime) copyrights outside of Japan is because a lot of licenses were signed before there was a coherent international agreement.

Piranha Games has filed a motion to dismiss with prejudice, stating that Harmony Gold does not hold the copyright on the images in question.
