Default Floating Nose

1) Can I decide to birbe Floating Nose also when the combact is already started? (i.e. I use potions, friends play enhancers, I can win no more, I birbe the monster)

2) Bad stuffs happend only if I can't escape. So, shoulden't "You cannot flee" be written on the card in the description of the monster and not in the bad stuff?!

It hasn't ever been a problem in the games I've seen -- people are pretty good about asking what the Bad Stuff is. For the record, however, it is an official ruling that "You cannot flee" means the Bad Stuff is automatic, no matter where on the card it is written.
