Well, the Silmarils originally
were owned by royalty, i.e. Feanor and his sons. But Maedhros waived their claim to kingship over the Noldor, transferring the crown to Fingolfin (albeit some of his brothers privately resented this). But the ownership of the Silmarils didn't transfer with the crown. Then the sons of Feanor found that their own claim of ownership on the gems had been voided by God, so that claim too was null.
Actually, it's not clear that
anyone owns the Silmarils after the First Age, or that anyone
can own them.
